Please read these Terms & Conditions carefully before using the JEKAFLY platform (website, mobile application, and any related digital channels operated by Kazwhale Concepts Limited). By creating an account, making a booking, or otherwise using any JEKAFLY service, you agree to be legally bound by these Terms & Conditions. If you do not agree, you must not use the Platform.
1Introduction and Acceptance of Terms
1.1These Terms & Conditions of Use ("Terms") govern access to and use of the JEKAFLY® digital platform, including the website www.jekafly.com, any mobile application, and any related booking, advisory, or account-management channel operated by Kazwhale Concepts Limited (together, the "Platform").
1.2By accessing the Platform, creating an account, making a booking or enquiry, or otherwise using any JEKAFLY service, you ("the User", "you", "your") confirm that you have read, understood, and agree to be legally bound by these Terms, together with our Privacy Policy, which is incorporated into these Terms by reference.
1.3Where you use the Platform on behalf of another person (for example, booking travel for a family member, employee, or client), you confirm that you are authorised to accept these Terms on their behalf and to bind them to the obligations set out here.
1.4Certain JEKAFLY services (in particular JEKAFLY Visa consultation) are additionally governed by supplementary terms and engagement-specific documents, which shall apply alongside these Terms. In the event of any direct conflict between these Terms and a supplementary service-specific agreement signed by the parties, the supplementary agreement shall prevail solely in respect of the specific service it covers.
2Definitions and Interpretation
2.1In these Terms, unless the context requires otherwise:
- "JEKAFLY", "we", "us", or "our" means JEKAFLY®, a digital travel and aviation services brand owned and operated by Kazwhale Concepts Limited, a company duly incorporated under the laws of the Federal Republic of Nigeria.
- "Platform" means the JEKAFLY website, mobile application(s), and any other digital or offline channel through which JEKAFLY makes its Services available.
- "Services" means, collectively, JEKAFLY Flights, JEKAFLY Visa, JEKAFLY Stay, JEKAFLY Consult, and JEKAFLY Holidays, and any other service later introduced on the Platform.
- "Supplier" or "Third-Party Provider" means any licensed airline, hotel, accommodation provider, tour operator, visa application centre, insurance provider, ground transport company, or other independent third party that ultimately supplies, delivers, or fulfils a travel product or service booked or arranged through the Platform.
- "Booking" means a confirmed reservation, purchase, or engagement for any Service made by a User through the Platform.
- "User Content" means any review, rating, comment, photograph, or other material a User submits to the Platform.
- "Relevant Authority" means any embassy, high commission, consulate, visa application centre, immigration department, or government body responsible for determining the outcome of a visa or immigration application.
2.2Headings are for convenience only and do not affect interpretation. References to "writing" include email and other electronic communication. The Naira (₦) is the primary reference currency of the Platform unless otherwise stated for a specific Service.
3About JEKAFLY
3.1JEKAFLY® is a digital travel and aviation services platform operated by Kazwhale Concepts Limited. JEKAFLY is not an airline, hotel, tour operator, or immigration authority, and does not itself own or operate aircraft, accommodation properties, or transport fleets.
3.2JEKAFLY acts principally as an intermediary and facilitator, connecting Users with licensed third-party Suppliers, and, through JEKAFLY Consult, provides advisory and administrative support services directly. All legal, operational, and financial responsibilities of JEKAFLY are borne by Kazwhale Concepts Limited.
3.3JEKAFLY's registered office is at 13, Ayinke Street, Akoka, Lagos, Nigeria. JEKAFLY may be contacted at Kazwhaleconcepts@gmail.com.
4Eligibility and Account Registration
4.1To create an account or make a Booking, you must be at least 18 years old and have the legal capacity to enter into a binding contract under the laws of your country of residence. Minors may only be included in a Booking as a travelling companion of, and under the direct supervision of, an adult User.
4.2When registering an account, you agree to provide true, accurate, current, and complete information, and to promptly update that information if it changes. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4.3You must notify JEKAFLY immediately at Kazwhaleconcepts@gmail.com of any unauthorised use of your account or any other breach of security. JEKAFLY shall not be liable for any loss arising from your failure to safeguard your account credentials.
4.4JEKAFLY reserves the right to refuse registration, suspend, or terminate any account at its reasonable discretion, including where information provided is false, where fraudulent activity is suspected, or where these Terms have been breached.
5Description of Services
JEKAFLY provides its Services through five modular service lines. Each module operates subject to the general provisions of these Terms and the specific provisions set out below.
5.1 JEKAFLY Flights
(a)JEKAFLY Flights facilitates the search, comparison, and booking of flight tickets operated by licensed third-party airlines. JEKAFLY is a booking facilitator only; the contract of carriage is between the User and the operating airline, and is governed by that airline's own conditions of carriage, fare rules, baggage policy, and applicable international conventions (including the Montreal Convention 1999, where applicable).
(b)Flight schedules, fares, and availability are supplied by airlines or authorised global distribution systems (GDS) and may change without notice prior to confirmed ticket issuance. JEKAFLY shall notify the User of any material change known to it as soon as reasonably practicable.
(c)Name corrections, date changes, rebooking, and cancellations are subject to the operating airline's fare rules and any applicable airline-imposed fees, which are in addition to any JEKAFLY service fee.
5.2 JEKAFLY Visa
(a)JEKAFLY Visa provides visa advisory, eligibility assessment, document review, and application support services. JEKAFLY does not issue visas; approval, refusal, and the terms of any visa granted remain at the sole discretion of the Relevant Authority.
(b)JEKAFLY Visa engagements are additionally governed by JEKAFLY's Standard Terms & Conditions for Visa Consultation Services, which set out detailed provisions on fees, refunds, client obligations, and liability specific to visa advisory work, and which are provided to the Client at the point of engagement.
5.3 JEKAFLY Stay
(a)JEKAFLY Stay facilitates the reservation of hotel rooms and other accommodation through licensed accommodation providers. The contract for accommodation is between the User and the accommodation provider, and is subject to that provider's own check-in/check-out policies, house rules, and cancellation terms, which are disclosed to the User at the point of booking wherever reasonably available.
(b)JEKAFLY does not inspect, own, or control any accommodation property listed or booked through the Platform, and is not responsible for the physical condition, safety, or standard of any property, save to the extent required by applicable Nigerian consumer protection law.
5.4 JEKAFLY Consult
(a)JEKAFLY Consult provides travel advisory, itinerary planning, and relocation guidance services to individuals, corporate clients, and organisations managing travel programmes. This includes route planning, destination guidance, budgeting support, and coordination between other JEKAFLY modules on the Client's behalf.
(b)Advice given under JEKAFLY Consult is based on information reasonably available to JEKAFLY at the time and does not constitute legal, immigration, tax, medical, or financial advice unless expressly stated. Clients requiring regulated professional advice should seek it from an appropriately licensed professional.
5.5 JEKAFLY Holidays
(a)JEKAFLY Holidays curates and facilitates leisure and tour packages, including domestic Nigerian destination collections and international "Passport Builder" packages, in collaboration with licensed tour operators, accommodation providers, and ground-handling partners.
(b)Package itineraries, inclusions, and pricing are as described on the Platform or in the applicable package confirmation at the time of booking, and are subject to change due to seasonal availability, weather, local conditions, or circumstances affecting a Supplier, in which case JEKAFLY will use reasonable efforts to offer a comparable alternative or notify the User promptly.
6Booking Process, Order Confirmation and Contract Formation
6.1A Booking request submitted through the Platform is an offer by the User to purchase the relevant Service, which JEKAFLY (or, where applicable, the relevant Supplier) may accept or decline. A binding Booking is formed only upon JEKAFLY's issuance of a confirmed booking reference, e-ticket, voucher, or written confirmation, and not upon mere submission of a request or payment initiation.
6.2Prices displayed on the Platform are indicative and may change prior to confirmed Booking due to currency fluctuation, fare/rate changes by a Supplier, or correction of a technical or pricing error. Users will be notified of any material price change before payment is finalised.
6.3The User is responsible for reviewing all Booking details (including names, dates, destinations, and passport details) before confirming payment, as errors may not be correctable without additional charges once a Booking has been processed with a Supplier.
6.4Upon confirmation, JEKAFLY will issue the applicable booking reference, e-ticket, hotel voucher, itinerary, or engagement confirmation to the email address or contact details provided by the User.
7Pricing, Payment Terms and Currency
7.1Prices are quoted in Nigerian Naira (₦) unless otherwise indicated for a specific international product, and are inclusive of applicable JEKAFLY service fees unless stated otherwise. Government taxes, airport charges, visa fees, and other third-party costs are itemised separately where applicable.
7.2Payments made through the Platform are processed via licensed third-party payment gateways and processors. JEKAFLY does not store full card details on its own servers; such payment data is handled directly by the payment processor in accordance with applicable card industry security standards.
7.3Accepted payment methods may include debit/credit card, bank transfer, USSD, and other channels supported by JEKAFLY's payment partners from time to time. Where a payment is declined, reversed, or subject to a chargeback initiated in bad faith after a Service has been rendered or a Supplier has confirmed a Booking, JEKAFLY reserves the right to recover the relevant sum from the User and to suspend the User's account pending resolution.
7.4Where a transaction is conducted in a foreign currency, the User is responsible for any currency conversion charges or fees applied by their card issuer or bank, which are outside JEKAFLY's control.
8Cancellations, Amendments and Refunds
8.1Cancellation and amendment terms differ by Service and are governed by the applicable Supplier's policy, disclosed to the User at the point of Booking wherever reasonably available:
- JEKAFLY Flights — governed by the operating airline's fare rules; many discounted fares are non-refundable or attract a rebooking fee.
- JEKAFLY Stay — governed by the accommodation provider's cancellation policy, which may range from free cancellation up to a stated date to fully non-refundable rates.
- JEKAFLY Holidays — governed by the applicable tour operator's package terms, which typically apply a sliding scale of cancellation charges depending on how close to the travel date the cancellation is made.
- JEKAFLY Visa — governed by JEKAFLY's Standard Terms & Conditions for Visa Consultation Services; consultation fees for work already performed are non-refundable regardless of visa outcome.
8.2Where JEKAFLY charges its own service fee for facilitating a Booking, that service fee is earned upon confirmation of the Booking and is non-refundable, except where JEKAFLY is at fault for an error in processing the Booking.
8.3Any refund due from a Supplier will be processed by JEKAFLY to the User's original payment method within a reasonable time of JEKAFLY receiving the corresponding refund from the Supplier, less any non-refundable charges already disclosed.
8.4No refund shall be made in respect of a User's failure to check in, missed flight, no-show at a hotel, or non-attendance at a scheduled activity, save where the applicable Supplier's policy expressly provides otherwise.
9Travel Documents, Visa and Immigration Responsibility
9.1It is the User's sole responsibility to hold a valid passport, visa, Electronic Travel Authorisation (ETA), and any other travel document required for their itinerary, and to comply with the entry, health, customs, and immigration requirements of every transit and destination country.
9.2JEKAFLY shall not be liable for any denial of boarding, denial of entry, deportation, quarantine, fine, or other consequence arising from a User's failure to hold the correct or valid travel documentation, save to the extent such failure results directly from JEKAFLY's own negligence in a JEKAFLY Visa engagement governed by its supplementary visa consultation terms.
9.3Where JEKAFLY Consult or JEKAFLY Visa has provided guidance on documentation requirements, that guidance is based on information published by the Relevant Authority at the time and is not a substitute for the User independently verifying current requirements before travel, as immigration rules may change without notice.
10Third-Party Suppliers
10.1Where JEKAFLY facilitates a Booking with a Supplier (airline, hotel, tour operator, ground transport provider, insurer, or similar), JEKAFLY acts as an intermediary. The contract for the underlying travel product or service is formed directly between the User and the Supplier, and is subject to the Supplier's own terms and conditions, which take precedence over these Terms in respect of matters exclusively within the Supplier's control (such as flight operation, room standard, or on-ground service delivery).
10.2JEKAFLY exercises reasonable care in selecting Suppliers but does not guarantee, and shall not be liable for, the acts, omissions, insolvency, service standard, or contractual performance of any independent Supplier, except to the extent such liability cannot be excluded under applicable Nigerian law.
11User Conduct and Prohibited Activities
11.1When using the Platform, you agree not to:
- provide false, fraudulent, or misleading information in connection with any Booking or account registration;
- use the Platform for any unlawful purpose, including money laundering, fraud, or the facilitation of illegal immigration;
- attempt to gain unauthorised access to the Platform, other Users' accounts, or JEKAFLY's systems, or to reverse-engineer, scrape, or extract data from the Platform other than through officially supported means;
- initiate a fraudulent chargeback or payment reversal after a Service has been rendered;
- engage in abusive, threatening, or harassing conduct towards JEKAFLY staff, other Users, or Suppliers;
- upload or transmit any virus, malware, or other harmful code to the Platform.
11.2JEKAFLY reserves the right to investigate suspected violations of this Clause 11 and to suspend or terminate the relevant account, cancel associated Bookings, and, where appropriate, report the conduct to law enforcement or regulatory authorities.
12Reviews and User-Generated Content
12.1Where the Platform allows Users to submit reviews, ratings, photographs, or other content ("User Content"), the User grants JEKAFLY a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, publish, and display that User Content on the Platform and in JEKAFLY's marketing materials, with attribution where reasonably practicable.
12.2User Content must be truthful, based on genuine experience, and must not be defamatory, obscene, discriminatory, or infringe the rights of any third party. JEKAFLY reserves the right to moderate, edit, or remove any User Content at its discretion, without obligation to provide reasons.
13Intellectual Property
13.1The JEKAFLY® name, logo, tagline, and all associated branding are the exclusive property of Kazwhale Concepts Limited. All content on the Platform, including text, graphics, itineraries, curated packages, software, and design, is owned by or licensed to JEKAFLY and is protected by Nigerian and international intellectual property law.
13.2Users are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal or authorised business travel purposes only. No right is granted to reproduce, resell, or create derivative works from JEKAFLY's content or branding without prior written consent.
14Disclaimers
14.1The Platform and Services are provided on an "as is" and "as available" basis. While JEKAFLY takes reasonable steps to ensure the accuracy of information displayed (including prices, schedules, and availability), such information is ultimately sourced from Suppliers and third-party systems and may be subject to change or error beyond JEKAFLY's control.
14.2JEKAFLY does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components, and shall not be liable for any temporary unavailability of the Platform due to maintenance, technical failure, or circumstances beyond its reasonable control.
15Limitation of Liability
15.1To the fullest extent permitted by law, JEKAFLY's total aggregate liability to a User arising out of or in connection with the use of the Platform or any Service, whether in contract, tort (including negligence), or otherwise, shall not exceed the total JEKAFLY service fees actually paid by that User in respect of the specific Booking or Service giving rise to the claim.
15.2JEKAFLY shall not be liable for any indirect, incidental, consequential, or special loss or damage, including loss of income, loss of business opportunity, missed connections, or the acts, omissions, or insolvency of any independent Supplier.
15.3Nothing in these Terms excludes or limits JEKAFLY's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the laws of the Federal Republic of Nigeria, including applicable provisions of the Federal Competition and Consumer Protection Act 2018.
16Indemnification
16.1You agree to indemnify and hold harmless JEKAFLY, Kazwhale Concepts Limited, and their respective directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your provision of false or misleading information in connection with a Booking.
17Travel Insurance
17.1JEKAFLY strongly recommends that all Users obtain comprehensive travel insurance covering medical emergencies, trip cancellation, lost baggage, and related risks before travelling. Where travel insurance is offered through the Platform, it is underwritten by a licensed third-party insurer, and JEKAFLY is not a party to, and assumes no liability under, the insurance contract.
18Force Majeure
18.1JEKAFLY shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, airline or airport disruption, government action, embassy closures, industrial action, or natural disaster.
19Health, Safety and Travel Advisories
19.1Users are responsible for reviewing official travel advisories, health requirements (including vaccination and testing requirements), and security guidance issued by relevant government authorities for their intended destination before travel. JEKAFLY may share such advisories as a courtesy but does not guarantee their completeness or currency.
20Suspension and Termination of Accounts
20.1JEKAFLY may suspend or terminate a User's account and access to the Platform, with or without notice, where the User breaches these Terms, engages in fraudulent or unlawful conduct, or where required to do so by law or a competent authority.
20.2A User may close their account at any time by written request to Kazwhaleconcepts@gmail.com. Termination of an account does not affect any rights or obligations that accrued prior to termination, including payment obligations for confirmed Bookings.
21Governing Law and Dispute Resolution
21.1These Terms shall be governed by, and construed in accordance with, the laws of the Federal Republic of Nigeria.
21.2The parties shall first attempt to resolve any dispute arising out of or in connection with these Terms through good-faith negotiation. Where a dispute is not resolved within thirty (30) days, either party may refer the matter to mediation or arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act 2023, before resorting to litigation.
21.3Subject to Clause 21.2, the courts of Lagos State, Nigeria shall have exclusive jurisdiction over any dispute arising from these Terms.
22Amendments to These Terms
22.1JEKAFLY reserves the right to update or amend these Terms from time to time to reflect changes in its Services, legal requirements, or business operations. The updated Terms will be posted on the Platform with a revised "Effective Date", and material changes will, where reasonably practicable, be notified to registered Users by email or in-app notice.
22.2Continued use of the Platform after the effective date of updated Terms constitutes acceptance of those updated Terms. Users who do not agree to updated Terms should discontinue use of the Platform and may close their account as described in Clause 20.2.
23Notices and Communication
23.1JEKAFLY may communicate with Users via the email address, phone number, or in-app notification associated with their account. Notices from JEKAFLY are deemed received 24 hours after being sent by email, or immediately upon delivery of an in-app notification.
23.2Users should direct all official communication regarding their account or a Booking to JEKAFLY's official channels, including Kazwhaleconcepts@gmail.com, and should not rely on informal communication with individual staff members outside these channels.
24Severability, Entire Agreement, Assignment and Waiver
24.1If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
24.2These Terms, together with the Privacy Policy and any applicable supplementary service-specific terms, constitute the entire agreement between the User and JEKAFLY in relation to use of the Platform, and supersede all prior discussions or agreements on the subject.
24.3JEKAFLY may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, upon notice to Users where required by law. Users may not assign their rights under these Terms without JEKAFLY's prior written consent.
24.4No failure or delay by JEKAFLY in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise of a right preclude any other or further exercise of that right.
